This course investigates the Doctrine of Joint and Severable Liability. When two or more persons or entities are alleged to be liable to another either due to breach of contract or a tortious wrong such as negligence or assault, the doctrine of joint and several liability can come into play. Joint tortfeasors are two or more individuals with joint and several liability in a tort action for the same injury to the same person or property. In this course you will study: pure joint and several liability; modified joint and several liability; and pure several liability. You will also review equitable contribution and subrogation and all legal doctrine will be underpinned with interesting case studies.
