This course reviews the Law of Duty to Defend. The purpose of this course is to inform you on the insurer's obligation to defend the insured (or provide a defense) for a claim the insured files under their policy. The term duty to defend refers to the insurer's obligation to defend the insured (or provide a defense) for a claim they file under their policy. The insurer may either enlist a member of its legal staff to defend the insured or hire an attorney at an outside law firm to provide a defense. In this course we will study: what the duty to defend is AND when it is activated; an insurer’s obligation of “reasonable performance”; defense expenses and policy limits; and the consequences of a breach of Duty to Defend. The legal doctrines discussed in the course are supported by numerous case studies to keep the course both interesting and instructive.
