The Law of Duty to Investigate and Settle

The purpose of this course is to better equip you in your professional activities as an Insurance Agent or Insurance Adjuster.

This course reviews the Law of Duty to Defend. This course is meant to serve as a primer to the duty and insurance company has to fully investigate and settle claims. The bottom line is that an insurance company has a duty to fully investigate an insured's claim for benefits before denying it. This course reviews the requirement of a “full, fair and thorough investigation": thorough investigation; fair evaluation; an impartial examination of the insured's proof of loss statement and supporting documents. The doctrines of: “narrow focus investigations”; “evidence that might establish coverage”; and “bad faith” are all discussed. The student will find that an insurance company cannot ignore evidence that is available to it which supports the claim. That is, the insurance company cannot focus only on the facts that would justify its denial of the claim. Case studies will demonstrate that a carrier’s failure to fully and completely investigate a claim at its submission can result in the imposition of bad-faith damages in a subsequent lawsuit. As with our other “The Law Of” courses the legal doctrines discussed in the course are supported by numerous case studies to keep the course both interesting and instructive.
